Professional Liability Insurance for Scuba Instructors in Southeast Asia

Professional Liabily Insurance for Diving Instructor Compared

One of the most common questions that newly certified dive instructors ask me after their PADI IDC; “Should I take professional liability insurance? Which one should I get?”

Some think dive accident insurance and professional liability insurance for diving instructors are the same thing. It’s not.
Dive accident insurance pays for your own hyperbaric chamber bill if you get bent. Professional liability insurance is different. It protects you if a student or client sues you, or threatens to, after something goes wrong. Two completely separate products.

In most of Southeast Asia, professional liability insurance isn’t a legal requirement. Thailand, Indonesia, and the Philippines do not force instructors to carry it by law. Even if it’s not required, I’d still highly recommend getting it. Even if you did nothing wrong, someone can still sue you.
A student panics, bolts to the surface, and gets bent. Or a guest slips on the boat. Even if it was not your fault, you can still get dragged into a lawsuit. Liability insurance covers the legal defense costs and damages, if needed.

I dove into the different options that are suitable for my PADI IDC graduates. This post compares the professional liability insurance providers for diving instructors that are relevant if you’re teaching in Southeast Asia. I’ve left out general diving accident insurance, dive center or business insurance, and anything aimed purely at recreational divers. This is about individual liability cover for instructors and divemasters.

A quick warning before we start: Not all information was clearly stated on the insurers’ websites, and insurance terms change often. Always check the current policy wording yourself before buying, and don’t take a blog post as the final word.

What to actually compare

Coverage limit.

Some policies set a limit per claim, others per year. Also, check whether legal defence costs come out of that limit or sit on top of it. If they come out of it, legal defense costs reduce what’s left to actually pay a claim.

Geographic coverage.

“Worldwide” sounds reassuring, but several policies quietly exclude certain countries or regions.

Who’s eligible.

Some policies are only available to EU residents. Others are US-only. A few will take anyone. Your nationality and country of residence both matter, so check eligibility before spending time on a quote.

What diving activities are covered.

Don’t assume your full teaching scope is included. Cave, technical, rebreather, freediving, wreck penetration, are often excluded or need a specific add-on. If you teach specialties, check each one.

Student cover.

Some insurers include free accident cover for your entry-level students. This is very useful. Without it, a student who gets hurt during a course has to sue you to get their medical costs covered. Student cover built into your policy avoids that whole situation.

Your own accident cover.

This is important. Liability insurance almost never covers your own injuries. That’s a separate product; dive accident insurance. Some insurers bundle both, but most sell them separately.

Professional indemnity.

In diving, this usually comes packaged with liability cover, but it’s worth knowing what it means. Liability covers a physical accident that happens during a course or activity under your supervision. Indemnity covers claims that your teaching was wrong or inadequate, even if the accident happened after the course ended. A student who gets DCS six months later and blames their training, for example. Most dive instructor policies cover both, but it is worth checking before you buy.

DAN banner

DAN — Divers Alert Network

Most divers know them for insurance, but they also fund diving medical research, and offer training for diving professionals.
The confusing part is that DAN is split into independent regional organisations. DAN America, DAN Europe, DAN Asia-Pacific, and others. Same name, different products, different rules.

DAN America — DAN Risk Retention Group (DAN RRG)

Based in Durham, North Carolina. Professional liability for US residents only. DAN’s US-based professional liability product is sold through DAN Risk Retention Group (DAN RRG). Important: this is liability-only. They also sell dive accident and travel insurance separately, and DAN recommends carrying both. They have an in-house medical and legal team that actually knows diving. SSI and NAUI both endorse them for US members.

DAN Europe — IDA Insurance Ltd

Based in Malta. Open to anyone with European residence. Their Pro plans are the most complete package on this list. Professional liability, cover for your entry level students, your own dive accident cover, and non-diving medical emergencies abroad, all in one plan.

They offer three packages, but the professional liability limit is the same across all three. What changes between tiers are your own accident cover and the number of free student slots. Important: legal defense is paid on top of the €4M limit, not out of it.

DAN Asia-Pacific — via DAN World

To be complete I should add DAN Asia Pacific based in Melbourne. DAN Asia-Pacific covers dive accidents and travel assistance for divers in the Asia-Pacific region, but they don’t offer professional liability insurance. If you’re teaching in Southeast Asia, DAN Europe, or DAN America is what you’re looking for, depending on your country of residence.

PADI Insurance

V-Insurance Group — PADI Asia Pacific Combined Liability

This is the one built most directly for the Southeast Asia region. Coverage is worldwide, not just Southeast Asia. However, it excludes the USA, Canada, and mainland China. V-Insurance is an Australian broker and the official PADI-endorsed insurance provider for PADI members. Registration asks for a PADI membership number.

This is only liability insurance. Dive Injury & Evacuation (for your own injuries) is a separate product.

Diveassure

DiveAssure — General Liability Plan (SSI endorsed, currently EU/UK only)

DiveAssure is SSI’s official insurance partner. The limit is generous, among the highest on this list. But, the territorial coverage on this plan is EU and UK only, and activities outside the EU aren’t covered, even for EU residents working abroad. That rules it out for anyone teaching in Southeast Asia.

StartDive is an entirely separate product that SSI activates automatically for students — it’s not part of this liability plan.

Dive assist

Dive Assist — Pro-Diver Annual Liability

Dive Assist is a smaller insurance resource aimed at the international dive trade, offering an annual Pro-Diver liability membership. Legal defence costs are paid in addition to the limit, similar to DAN Europe’s structure, and the policy covers instructing, supervising, and guiding across all major certifying agencies’ training programmes, worldwide. Instructors who are citizens from USA or Canada, are excluded.

Two published packages with a straightforward description: civil liability cover against claims from students, clients, and dive buddies. No mention of student cover or personal accident cover in the product listing on their site.

Aqua Med — dive card professional

Aqua Med is a German dive medical and insurance provider, offering worldwide professional liability insurance for instructors who keep an EU, Swiss, Liechtenstein, or UK residence. They offer one product that bundles personal accident cover (the base dive card) with professional liability as an add-on. Your own diving accident cover is the foundation; the professional liability layer goes on top.

Important: tech, rebreather, cave, cavern, ice, and wreck diving are excluded from both the accident cover and the liability. This is a meaningful restriction compared to DAN Europe. Student cover (Student Protect) is free and unlimited for beginner courses.

Before you buy

No single insurer is the right answer for everyone. Where you live, what agency you teach under, and what courses you run all change the picture.

A few things worth double-checking before you commit to any policy:

The liability limit, and whether legal defence costs eat into it. The geographic coverage — “worldwide” doesn’t always mean what it sounds like. Whether the activities you actually teach are covered, especially if you run tech, cave, or rebreather courses. Whether student cover is included, and whether your own accident cover is included or whether you need a separate policy on top.

Prices and terms change. Every figure in this article was pulled directly from each insurer’s website, but policies get updated, premiums shift, and the fine print moves around. Read the current policy document before buying, not just the marketing page.

Frequently Asked Questions

Is professional liability insurance legally required to teach diving in Thailand, Indonesia, or the Philippines?

No. There’s no legal requirement in any of these countries. PADI doesn’t require it for members working in Southeast Asia either, unlike in Europe, Australia, and the US, where agencies do enforce it. That said, many dive centers will ask for proof of cover before they hire you. And regardless of what’s required, it’s still highly recommended to have professional liability insurance when working as a diving instructor.

Is dive accident insurance the same as professional liability insurance?

No. Dive accident insurance covers your own medical costs if you get injured while diving. Professional liability insurance covers you if someone else, like a student or client, makes a claim against you. You need both, and one doesn’t substitute for the other.

Can I just use my dive center’s insurance instead of buying my own?

If your dive center has liability insurance, you might be covered by this. But only if you’re listed as staff on their policy and you never work outside that center. If you freelance, teach for multiple operators, or guide independently on the side, a dive center policy generally won’t cover those activities. Several insurers, including DAN Europe, specifically flag this distinction.

Does professional liability insurance cover me if I violated a training standard during the incident?

This depends entirely on the policy. Some policies will still defend you even if a standards violation contributed to the claim, since that’s often the whole point of liability cover. Others exclude claims arising from standards violations outright. Read the exclusions section of any policy you’re considering, not just the marketing page.

What happens to my cover if I work without a work permit in a country where that is legally required?

This is a real risk that most instructors don’t think about until it’s too late! DAN Europe explicitly states that your liability cover can become invalid if you break local employment or immigration laws in the US or Canada. Many insurers make no hard statements about what happens to your cover when you breach local laws. Don’t assume you’re covered regardless. If something goes wrong and the insurer finds out you weren’t legally authorised to work, they may refuse the claim. Getting your paperwork sorted isn’t just about avoiding trouble with immigration. It directly affects whether your insurance is actually worth anything.

Do I need separate cover for technical or cave diving?

Often, yes. Several insurers on this list, only include technical and rebreather coverage for instructors who hold the relevant qualification, and some exclude cave diving entirely unless specifically declared. DAN Europe is unusual in including technical, cave, and rebreather instruction in its standard Pro plans without extra cost.

If my student is fine but I get injured myself, am I covered?

Not automatically, with most insurers on this list. Liability insurance is built to cover claims made against you by someone else, not your own injuries. Only DAN Europe and aqua med genuinely bundle your own dive accident cover into the same product as your liability cover. With the others, including DAN’s US product, V-Insurance, and Dive Assist, you’d need a separate personal accident or dive injury plan to make sure you’re covered if you’re the one who gets hurt.

What happens to my coverage if I switch certifying agencies?

Liability insurance is tied to you as an individual, not to your agency, as long as the policy lists the agencies you’re certified through. If you cross over to a new agency, check whether you need to update your policy details, since some insurers require your training agencies to be declared upfront.
